Subscription lifecycle events (purchases, renewals, cancellations, refunds, restores) are coordinated by RevenueCat, a subscription management platform that validates IAP receipts and syncs status to our backend. 8.9 Right of Withdrawal (EU Consumer Rights Directive)
Under the EU Consumer Rights Directive (Directive 2011/83/EU) and Article L.221-18 of the French Consumer Code:
- You have a 14-day cooling-off period from the date of your subscription during which you may withdraw without giving any reason.
- For digital content: this right is waived with your explicit prior consent when you begin accessing Core features before the cooling-off period expires, and you acknowledge the loss of your right of withdrawal.
- To exercise your right of withdrawal, send a clear statement to support@lastribe.eu. The model withdrawal form is provided in Appendix A below.
- Any refund due will be processed within 14 days of receiving your withdrawal request, using the same payment method.
8.10 Withdrawal Waiver Consent Mechanism
When subscribing to Core or beginning your free trial, you will be asked to check a box stating: "I expressly request immediate access to Core features and acknowledge that I will lose my 14-day right of withdrawal once the digital service begins." A confirmation email (durable medium) documenting this consent is sent immediately.
8.11 Price Changes
We reserve the right to modify subscription pricing. If we change prices:
- You will receive at least 30 days' written notice by email before the new pricing takes effect.
- You may cancel your subscription before the price change takes effect without penalty.
- Continued use after the price change constitutes acceptance of the new pricing.
9. User Obligations & Acceptable Use
You agree to use the Service in compliance with all applicable laws and regulations. You must not:
- Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law.
- Post or share content that is defamatory, obscene, threatening, or that incites violence or hatred.
- Harass, bully, stalk, or intimidate other users.
- Engage in fear-mongering, alarmism, or collapse sensationalism.
- Promote political or ideological agendas unrelated to practical preparedness.
- Share military, paramilitary, or weapons-focused content.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems.
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Service.
- Use automated systems, bots, scrapers, or crawlers to access or interact with the Service.
- Upload or transmit malicious code, viruses, or any software intended to damage or disrupt the Service.
- Circumvent any feature limitations, rate limits, or access restrictions.
- Send unsolicited communications (spam) through the Service.
- Create multiple accounts to circumvent bans, restrictions, or free-tier limitations.
10. Content Guidelines & Tone
Lastribe is built on a philosophy of calm, competent, and empowering communication. All user contributions must reflect these values:
- Data-driven awareness -- not fear-mongering or sensationalism.
- Community building -- not divisiveness or tribalism.
- Practical knowledge -- not speculation or conspiracy theories.
- Empowerment -- not alarmism or helplessness.
We reserve the right to remove any content that violates these guidelines and to suspend or terminate accounts of users who repeatedly violate them. Content moderation decisions are made with reference to the principles outlined in Section 17 (Digital Services Act Compliance).
11. User-Generated Content
You retain ownership of all Content you submit, post, or display through the Service. By submitting Content, you grant EnableUnion SASU a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, and distribute such Content solely for the purpose of operating, developing, and improving the Service.
You represent and warrant that:
- You own or have the necessary rights and permissions to submit the Content.
- Your Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
- Your Content complies with these Terms and our Content Guidelines (Section 10).
We do not endorse, verify, or assume responsibility for any user-generated Content. Views expressed by users are their own and do not represent the views of Lastribe or EnableUnion SASU.
12. Household & Tribe Data Sharing
12.1 Household Data
When you join or create a Household, all members of that Household share access to:
- Household inventory (items, quantities, expiry dates).
- Household PrepScore and autonomy data.
- Individual member contributions to the Household.
All Household members can see each other's contributions to shared preparedness data.
12.2 Tribe Data
When you join a Tribe, other Tribe members can see your:
- Display name and city.
- PrepScore summary.
- Listed skills and preparedness interests.
Tribe leaders have additional visibility into member activity for the purpose of coordination and community management.
12.3 Leaving a Household or Tribe
When you leave a Household or Tribe, your personal data is removed from shared views. Community posts and contributions you made may be anonymized and retained to preserve the integrity of community discussions.
12.4 Leader Responsibilities
Tribe leaders are responsible for moderating their Tribe, approving new members, and ensuring that all Tribe activity complies with these Terms and our Content Guidelines. Leaders who fail to uphold these responsibilities may have their leader privileges revoked.
13. Geolocation & Responsible Use
The Service uses location data in limited and specific ways:
- Profile location: Stored at city level only. We never collect or store your precise GPS coordinates for your profile.
- Event evidence: GPS coordinates may be submitted voluntarily as proof of participation in specific events. This is always opt-in.
- Tribe proximity: Calculated from city-level data to determine geographic proximity, not from real-time tracking.
We never continuously track your location or share it with third parties without your explicit consent. Be mindful when sharing location information in community contexts -- even city-level data can be identifying in small communities.
14. Safety & Physical Activity Disclaimer
Note: Please read this section carefully. Some features of the Service involve or reference real-world activities that may carry inherent risks.
- Events may involve real-world activities such as outdoor exercises, first aid practice, or emergency drills. You participate at your own risk and must assess your own fitness and capabilities before engaging.
- The Service is not a substitute for professional emergency services, medical advice, or official government guidance.
- Offline/crisis mode: Cached data used in offline mode may be incomplete or outdated. Do not rely solely on cached information in a real emergency.
- Risk Radar: Risk assessments are AI-generated approximations and should not be treated as authoritative or exhaustive.
- PrepScore: An informational metric only. It is not a certification of actual readiness and should not be relied upon as such.
- Inventory tracking: Does not replace personal verification of your supplies. Always physically verify quantities, condition, and expiry dates.
- Users should maintain their own insurance coverage as appropriate for any preparedness activities they undertake.
15. Legal Guarantee of Conformity
In accordance with Articles L.224-25-1 to L.224-25-31 of the French Consumer Code, transposing Directive (EU) 2019/770 on the supply of digital content and digital services:
- The Service, including all Core Subscription features, is guaranteed to conform to the contract for the full duration of your subscription period. This means the Service must match the description provided in these Terms, possess the qualities presented, and be fit for the purposes normally expected of a similar digital service.
- If a lack of conformity appears during your subscription period, you may request that the Service be brought into conformity at no additional cost to you.
- If bringing the Service into conformity is impossible or would impose disproportionate costs, you are entitled to a proportionate price reduction or to terminate the contract and receive a prorated refund for the remaining subscription period.
- During the first year of your subscription, you do not need to prove that the lack of conformity existed at the time of supply -- the burden of proof is reversed in your favor.
- In addition, the legal guarantee against hidden defects (garantie des vices caches) applies pursuant to Articles 1641 to 1649 of the French Civil Code. If a hidden defect renders the Service unfit for its intended use or significantly diminishes its usefulness, you may request a price reduction or contract termination.
16. Artificial Intelligence & Machine Learning
The Service uses AI and machine learning in the following features:
- News classification: Categorization, relevance scoring, and summary generation for Risk Radar content.
- Risk index computation: Localized risk assessments based on aggregated data.
- Content moderation assistance: Automated detection of content that may violate our guidelines.
16.1 Technology & Data Hosting
All AI models are self-hosted within our EU infrastructure using Ollama. No user data is sent to external AI providers (such as OpenAI, Google, Anthropic, or any other third-party AI service).
16.2 Training Data
Anonymized user feedback (votes, corrections, and other interactions) may be used to improve model accuracy. This data is anonymized and aggregated before use in training.
16.3 Limitations
AI outputs are approximations that may contain errors. They are not authoritative and should not be treated as professional advice. All AI-generated content should be considered informational only.
16.4 Human Oversight
All AI model behavior is auditable and adjustable by our administration team. We maintain human oversight of all automated processes that affect user experience. In accordance with EU AI Act Article 4, we ensure that our staff involved in the operation and use of AI systems have sufficient AI literacy appropriate to their functions.
16.5 Opt-Out
You may request exclusion of your feedback from AI training data by emailing privacy@lastribe.eu. Note that this applies to training data only -- AI features that process public content (e.g., news classification) will continue to function as part of the Service.
16.6 AI Content Labeling
In accordance with the EU AI Act (Regulation 2024/1689, Article 50), content generated or significantly modified by AI -- including Risk Radar summaries, risk scores, and situation briefs -- is clearly labeled as AI-generated within the Service.
17. Digital Services Act (DSA) Compliance
In accordance with Regulation (EU) 2022/2065 (the Digital Services Act):
17.0 DSA status
Lastribe is operated by EnableUnion SASU, established in the EU (France). For DSA purposes, EnableUnion SASU is a micro-enterprise (fewer than 10 employees, annual turnover below €2 million) within the meaning of Commission Recommendation 2003/361/EC, and Lastribe is a hosting service for user-generated content (tribe messages, hazard reports, public profile fields, comments).
Pursuant to Article 19 of the DSA, micro and small enterprises are exempt from Section 3 of the DSA (online platform additional obligations, Articles 20-28) — notably from internal complaint-handling certification (Art. 20), trusted-flagger procedures (Art. 22), measures against misuse (Art. 23), periodic transparency reporting (Art. 24), online interface design constraints beyond ordinary unfair-commercial-practice law (Art. 25), advertising transparency rules (Art. 26), recommender system transparency obligations (Art. 27), and platform-specific online protection of minors (Art. 28). EnableUnion SASU is also exempt from the hosting-service transparency reporting of Article 15.
This Section nonetheless documents how we comply with the provisions that do apply to a hosting service of our scale: Articles 11, 12, 14, 16, 17 and 18.
17.1 Single point of contact (Articles 11 and 12)
| Audience | Contact | Languages |
|---|---|---|
| Authorities of the Member States, the European Commission, the European Board for Digital Services (Article 11) | dsa@lastribe.eu | English, French |
| Recipients of the service (Article 12) | dsa@lastribe.eu (DSA-specific) and support@lastribe.eu (general) | English, French |
We commit to acknowledge authority enquiries within 5 working days and to provide a substantive response within timeframes set by the requesting authority.
17.2 Terms of use clarity (Article 14)
The restrictions we may impose on user-generated content are set out in plain language in Section 9 (User Obligations & Acceptable Use) and Section 10 (Content Guidelines & Tone) of these Terms. Section 24 (Suspension & Termination) describes our enforcement actions. We do not apply restrictions outside what those sections describe.
17.3 Content moderation
We moderate user-generated content to enforce Sections 9 and 10 and applicable law. Moderation combines automated detection (AI classification trained on the categories listed in Section 10) and human review. No content is removed solely on the basis of an automated decision — every removal is confirmed by a member of the EnableUnion team.
17.4 Notice-and-action mechanism (Article 16)
Any individual or entity — whether or not a user of the Service — may notify us of the presence of illegal content on Lastribe through the following electronic channel:
Email: dsa@lastribe.eu
To allow us to assess the notice diligently, please include: (a) a substantiated explanation of the reasons why you believe the content is illegal; (b) a clear indication of the exact location of the content (URL, in-app screen, screenshot, or item ID); (c) your name and contact email (notices may be submitted anonymously, but anonymity may make it harder to confirm receipt and follow up); (d) a statement that the information provided is accurate and complete and submitted in good faith.
We process notices in a timely, diligent, non-arbitrary and objective manner. We send confirmation of receipt to the email address you provide, and we communicate our decision (with the statement of reasons set out in §17.5 when the decision affects another user's content) without undue delay.
Note on platform model. Lastribe is a trust-gated community platform: tribe membership is by leader approval, messaging is reserved to Core subscribers, and accounts are 18+. In practice users only interact with people they know in real life. The in-app Report control today serves the hazard-reporting flow (a user submits a new real-world hazard observation that other users can confirm or deny — see Section 6) and is not a substitute for the Article 16 notice-and-action mechanism above. Given the trust-gated model and the resulting low volume of expected illegal-content notices, the email channel above is the operational notice-and-action mechanism and is sufficient for our scale. We will introduce a dedicated in-app illegal-content reporter for tribe messages, comments and public profiles if user behaviour or notice volume changes the trade-off.
17.5 Statement of reasons (Article 17)
When we restrict the visibility of, suspend, or remove an item of user-generated content, or restrict, suspend or terminate the providing user's account, we send the affected user a clear and specific statement of reasons that includes: (a) whether the action consists of removal, demotion, restriction or termination, and the territorial / temporal scope; (b) the facts and circumstances relied on; (c) where applicable, information on the use of automated means in making the decision; (d) where the action concerns allegedly illegal content, the legal ground relied on and an explanation of why the content is considered illegal on that ground; (e) where the action concerns alleged Terms violations, the contractual ground relied on and an explanation of why the content is considered to violate it; (f) redress channels — replying to the statement, contacting dsa@lastribe.eu, or seeking court redress.
17.6 Suspicions of criminal offence (Article 18)
If, in the course of moderation, we become aware of information giving rise to a suspicion of a criminal offence involving a threat to the life or safety of a person or persons, we promptly inform the law enforcement or judicial authorities of the Member State(s) concerned, providing all relevant information available. Where the Member State cannot be identified with reasonable certainty, we notify the law enforcement authorities of the Member State in which EnableUnion SASU is established (France) or of the user's country of residence (where known), and we may also inform Europol.
17.7 Voluntary good practices (not DSA obligations)
The following measures are offered voluntarily, beyond the strict scope of what Article 19 requires of a micro-enterprise:
- Internal review. A user who receives a statement of reasons under §17.5 may reply to that statement within 6 months to request a human re-review. We will respond within a reasonable timeframe. This mechanism is offered as a good-faith service, not as a DSA Article 20 / 23 internal complaint-handling system (from which we are exempt).
- Out-of-court redress. If the disagreement is consumer-related (subscription, refund, billing), the consumer-mediation process described in Section 32 is available. We are not bound by Article 21 DSA out-of-court dispute settlement procedures (exempt).
18. Intellectual Property
The Service, including but not limited to its design, features, functionality, logos, trademarks, user interface, underlying software, PrepScore algorithm, course content, and platform source code, is the exclusive property of EnableUnion SASU and is protected by French and international intellectual property laws, including copyright, trademark, patent, and trade secret laws.
You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on the Service or any of its components without our prior written consent.
The "Lastribe" name, logo, and all related marks are trademarks of EnableUnion SASU. Use of these marks without prior written authorization is strictly prohibited.
19. Privacy & Data Protection
Your privacy is fundamental to how we build and operate Lastribe. Our Privacy Policy describes in detail how we collect, use, store, and protect your personal data in compliance with the General Data Protection Regulation (GDPR) and applicable French data protection law.
The Privacy Policy is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
20. Cookies and Trackers
The Service uses essential cookies for authentication and, with your prior consent, analytics trackers for product improvement. Non-essential trackers are never loaded before you provide explicit consent. For full details, see the Cookies & Tracking section of our Privacy Policy.
21. Third-Party Services
The Service integrates with the following third-party providers to deliver its functionality:
- Apple / Google -- In-app purchase processing via App Store (iOS) and Google Play Store (Android).
- RevenueCat -- Subscription management: receipt validation, renewal/cancellation/refund sync, subscriber state.
- Resend -- Transactional email delivery.
- Expo -- Push notifications for the mobile application.
- PostHog -- Product analytics (EU-hosted, GDPR-compliant).
- Sentry -- Error monitoring and performance tracking.
These third-party services are subject to their own respective terms of service and privacy policies. We are not responsible for the practices, policies, or availability of these third-party services.
22. App Store Terms
When you purchase a subscription through the Apple App Store or Google Play Store, the respective store's terms also apply to your purchase. Billing disputes for app-store-processed purchases should be directed to the respective store.
23. Service Availability & Modifications
We strive to maintain the Service available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:
- Scheduled maintenance: We will provide reasonable advance notice when possible.
- Emergency updates: Critical security patches or bug fixes that require immediate deployment.
- Force majeure events: Circumstances beyond our reasonable control (see Section 30).
We reserve the right to modify, update, or discontinue features of the Service. Modifications during a subscription period will only occur for valid reasons specified in this contract, including security requirements, legal compliance, and technical necessity. Modifications will not impose additional costs on the consumer. The consumer will be clearly informed in advance of any such modification. If a modification negatively and significantly affects the consumer's access to or use of the Service, the consumer may terminate the contract within 30 days of being informed at no cost and receive a prorated refund for the unused portion of the subscription period, in accordance with Directive (EU) 2019/770, Article 19.
For significant changes that affect paid subscribers and do not fall within the above categories, we will provide at least 30 days' notice by email.
We will provide necessary updates, including security updates, to maintain the Service in conformity throughout your subscription period, as required by Article L.224-25-6 of the French Consumer Code.
24. Suspension & Termination
24.1 Data Portability
At any time during your use of the Service, you may request a copy of your personal data in a structured, machine-readable format (JSON) from your account settings, independently of any account deletion. This right is provided under Article 20 of the GDPR.
24.2 Termination by You
You may delete your Account at any time from your account settings. Upon deletion:
- Your personal data will be deleted in accordance with our Privacy Policy.
- If you have an active Core Subscription, your access will continue until the end of your current billing period. Alternatively, you may request immediate deletion with a prorated refund for the unused portion of your billing period.
- Community content you contributed may be anonymized and retained to preserve the integrity of community discussions.
- Before deletion, you may request a data export (GDPR data portability right) by contacting support@lastribe.eu or through your account settings.
24.3 Termination or Suspension by Us
We may suspend or terminate your Account if:
- You violate these Terms or our Content Guidelines.
- We are required to do so by law or court order.
- Your Account has been inactive for more than 24 months, and we have sent you a reactivation reminder at least 30 days before the scheduled termination without receiving a response.
- We reasonably suspect fraudulent, abusive, or unauthorized activity.
Where possible, we will provide notice and an opportunity to remedy the issue before suspension or termination. For serious violations (e.g., illegal activity, harassment, security threats), we may act immediately. In all cases, you will receive a statement of reasons explaining the decision, in compliance with the Digital Services Act.
25. Accessibility
We are committed to making the Service accessible to all users in compliance with the European Accessibility Act (EAA) (Directive (EU) 2019/882) and the Web Content Accessibility Guidelines (WCAG):
- We target WCAG AA compliance for all content.
- We target WCAG AAA compliance for critical information (alerts, scores, safety-related content).
- Our accessibility statement is available at www.lastribe.eu/accessibility, describing our current level of compliance, known limitations, and remediation plans.
If you encounter any accessibility issues, please report them to support@lastribe.eu. We take accessibility reports seriously and will work to address them promptly.
26. Disclaimers
